Courts Serving Newark

Newark has no courthouse of its own. Alameda County assigns filings by case type, and for most Newark civil and family matters that means the Hayward Hall of Justice.

Hayward Hall of Justice

24405 Amador Street
Hayward, CA 94544

Family law filings for all of Alameda County, a civil clerk's office in Room 108, unlawful detainers from across the county (Department 511), and small claims hearings. Clerk's office hours are 8:30 a.m. to 3:00 p.m. Monday through Thursday and 8:30 a.m. to 2:00 p.m. on Friday, and the drop box stays open until 4:00 p.m.

More for Newark cases

Mandatory E-Filing in Alameda County

Mandatory E-Filing in Alameda County

Attorneys must e-file in all civil cases through an approved e-filing service provider (Local Rule 3.27), and e-filing has been mandatory for represented parties in family law and probate since 2023. Self-represented parties may e-file but aren't required to. Alameda County e-filing details

No Courthouse in Newark

Alameda County assigns filings by case type, not by city: civil cases at the Hayward Hall of Justice or the René C. Davidson Courthouse in Oakland, family law at Hayward, and probate at the Berkeley Courthouse (Local Rule 1.9). Every unlawful detainer is assigned to Department 511 in Hayward. We route each filing to the right building.

Registered Process Servers Serve Most Levies

The Alameda County Sheriff won't serve bank levies, wage garnishments, third-party levies, or rent levies unless the creditor is incarcerated or has a court fee waiver. Those levies must be served by a registered process server, and ours handle them. For the levies only the Sheriff can serve, we work with the Sheriff's Civil Section at 1225 Fallon Street, Room 104. Methods of service

How Individuals Are Served in Newark

California law allows several ways to serve a person. We always try personal service first and document every attempt so your proof of service holds up to challenge.

  • CCP § 415.10

    Personal Service

Documents are handed directly to the individual. This is the most defensible method in court and always our first approach.

  • CCP § 415.20

    Substitute Service

After reasonable diligence, documents may be left with a competent adult at the person's home or usual place of business, then mailed first-class to the same address. Every prior attempt is documented in writing so the proof of service holds up to challenge.

Starting January 1, 2027, AB 747 requires at least three good faith attempts at personal delivery, on three different days at three different times, before substitute service on an individual. Each attempt will also need a photo of the service location stamped with the date, time, and GPS coordinates. Every Direct Legal order already includes up to 4 to 6 attempts at a single California address.

  • § 415.20(c)

    Private Mailboxes

When a private mailbox at a mail store, such as a UPS Store, is the only address we can find, the papers can be left with the store on the first attempt. The store then mails them to the box holder. A regular USPS P.O. Box cannot be used for service.

  • CCP § 415.21

    Gated Communities

When a gated community is staffed by a guard or other security personnel, they must let a registered process server in for a reasonable time to serve papers. Our servers work with gate staff at guarded townhome and apartment communities across Newark and document each attempt.

  • CCP § 415.50

    Service by Publication

When a defendant can't be located after standard methods are exhausted, a court may authorize publication in a qualifying newspaper. We can prepare the declaration of diligence the court requires.

  • Court-ready

    Proof of Service

Every completed service produces a signed proof of service on the Judicial Council form, in your account and inbox the moment service is done, ready to file.

Business entities

Serving Corporations and Businesses in Newark

Newark's economy mixes technology and life sciences campuses, manufacturing, and large distribution and fulfillment operations along the Dumbarton corridor and I-880, plus retail around NewPark Mall. Corporate service here often means a campus lobby or a warehouse front office, where the company's registered agent is rarely on site.

Key Rules for Serving a Business in Newark

  • A corporation can be served through its registered agent for service of process, or through an officer or general manager (CCP § 416.10).
  • Limited liability companies and partnerships are usually served through their registered agent. You can look up an agent on the California Secretary of State business search.
  • When a company's registered agent is a commercial agent in Los Angeles County or Sacramento, our statewide servers handle that too, on the same order.
  • A standard USPS P.O. Box is never a valid address for service; a physical street address is required. If the only address we can find is a private mailbox at a mail store, such as a UPS Store, the papers can be left with the store on the first attempt (CCP § 415.20(c)).
Questions

Newark Process Serving FAQs

How fast can you serve legal documents in Newark?

We offer routine, rush, and same-day service levels throughout Newark and southern Alameda County. Our servers work this territory every business day, so rush assignments go to a server already in the area, not into tomorrow's queue.

Is there a courthouse in Newark?

No. The nearest courthouse is the Fremont Hall of Justice, which hears criminal and traffic matters. Alameda County assigns civil filings by case type: civil cases are filed at the Hayward Hall of Justice or the René C. Davidson Courthouse in Oakland, family law at Hayward, unlawful detainers are assigned to Department 511 in Hayward, and probate is filed at the Berkeley Courthouse. Clerk's office hours are 8:30 a.m. to 3:00 p.m. Monday through Thursday and 8:30 a.m. to 2:00 p.m. on Friday, and the drop box stays open until 4:00 p.m.

Will the Alameda County Sheriff serve my bank levy or wage garnishment?

Usually not. The Alameda County Sheriff doesn't serve bank levies, wage garnishments, third-party levies, rent levies, or summonses and subpoenas unless the creditor is incarcerated or has a certified court fee waiver. Those must be served by a registered process server. Our registered servers handle them, and we prepare and submit the Sheriff's instructions for what the Sheriff still handles, such as evictions.

Is e-filing mandatory in Alameda County?

For attorneys, yes. Represented parties must e-file in all civil cases through an approved e-filing service provider under Local Rule 3.27, and e-filing has been mandatory for represented parties in family law and probate since 2023. Self-represented parties may e-file but aren't required to.

Where is your East Bay office?

Our East Bay office is at 39159 Paseo Padre Pkwy. #112, in Fremont, (510) 366-6953. Regional Manager Jason Burke oversees field operations, client accounts, and process server dispatch across Alameda County from that office. You can also place an order online any time.

What areas do you cover around Newark?

Every Newark neighborhood, plus Fremont, Union City, Hayward, Milpitas, and the rest of Alameda County, and through our statewide network, every city in California.

What happens if the person can't be found at the address I provide?

Our servers make multiple attempts at different times of day and document each attempt. Where permitted, we can complete substituted service under California law. If the subject can't be located at all, our licensed skip tracers can search for a current address before your deadline passes.

How much does a process server cost in Newark?

For law firms and legal departments, process serving in Newark is $120 for Standard service, $175 for Priority, $195 for Urgent same-day service, and $245 for On Demand. For parties without an attorney, the rates are $175, $225, $275, and $325. Each rate covers one person or entity at one address and includes up to 4 to 6 attempts and the first 50 pages.

What is changing for substitute service in California in 2027?

Beginning January 1, 2027, AB 747 requires at least three good faith attempts at personal delivery, on three different days at three different times, before substitute service can be used on an individual. Each attempt must also be documented with a photo of the service location stamped with the date, time, and GPS coordinates. Every Direct Legal order includes up to 4 to 6 attempts at a single California address.
